حرم الله الظلم على نفسه وجعله بين العباد محرماً، والله لا يحب الظالمين، ولا تحسبن الله غافلاً عما يعمل الظالمون، وكم في هذا الكون من ظلم وظلمات، ودعونا نقف اليوم على جانب من الظلم يقع على فئة كبيرة في المجتمع.
وهذا الظلم قديم يتجدد، لكن بصور وأنماط تختلف في شكلها وربما اتفقت في مضمونها. إنه ظلم المرأة. فقد ظلمتها الجاهليات القديمة، وتظلمها الجاهليات المعاصرة. تُظلم المرأة من قبل الآباء، والأزواج وتُظلم من قبل الصويحبات والحاسدات، بل وتُظلم المرأة من قبل نفسها أحياناً. تظلمها الثقافات الوافدة، والعادات والتقاليد البالية، تُظلم المرأة حين تمنع حقوقها المشروعة لها، وتُظلم حين تعطى من الحقوق ما ليس لها.
إنها أنواع وأشكال من الظلم لابد أن نكشف شيئاً منها، ونخلص إلى عظمة الإسلام في التعامل معها وضمان حقوقها، والاعتدال في النظرة إليها.

أجل إن ظلم المرأة قديم في الأديان والشعوب والأمم المختلفة فهي عند الإغريق سلعة تباع وتشترى في الأسواق، وهي عند الرومان ليست ذات روح، فهم يعذبونها بسكب الزيت على بدنها، وربطها بالأعمدة، بل كانوا يربطون البريئات بذيول الخيل ويسرعون بها حتى تموت، والمرأة عند القدماء من الصينيين من السوء بحيث يحق لزوجها أن يدفنها وهي حية ولم تكن المرأة عند الهنود ببعيد عن ذلك، إذ يرون الزوجة يجب أن تموت يوم موت زوجها، وأن تحرق معه وهي حية، على موقد واحد، وكذا الفرس فللرجل حق التصرف فيها بأن يحكم عليها بالموت أو ينعم عليها بالحياة. ولم تكن حال المرأة بأسعد من ذلك عند اليهودية المحرفة وكذا النصرانية، فهي عند اليهود لعنة لأنها أغوت آدم، وإذا أصابها الحيض فلا تُجَالس ولا تُؤاكل، ولا تلمس وعاءً حتى لا يتنجس!، كما أعلن النصارى أن المرأة باب الشيطان وأن العلاقة معها رجسٌ في ذاتها. ومن جاهليات العجم إلى جاهلية العرب، حيث كانوا يتشاءمون بمولدها حتى "يَتَوَارَى مِنَ الْقَوْمِ مِنْ سُوءِ مَا بُشِّرَ بِهِ أَيُمْسِكُهُ عَلَى هُونٍ أَمْ يَدُسُّهُ فِي التُّرَابِ" (النحل: من الآية59)، بل شهد القرآن على وأدهن وهن أحياء "وَإِذَا الْمَوْؤُودَةُ سُئِلَتْ بِأَيِّ ذَنْبٍ قُتِلَتْ" (التكوير:8، 9)، كانت تُظلم وتُعضل في ميراثها وحقوقها، وكانت ضمن المتاع الرخيص للأب، أو الزوج حق التصرف فيها.

ومن الجاهليات القديمة إلى الجاهليات المعاصرة حيث ظُلمت المرأة باسم تحريرها، سُلبت العبودية لخالقها واستعبدها البشر، واعتدوا على كرامتها، وفتنوها وأخرجوها من حضنها الدافئ، وحرموها لذة الأمومة وعاطفة الأبوة، فهامت على وجهها تتسول للذئاب المفترسة، وربما كدحت وأنفقت حتى تظل مع عشيقها، وربما سارع للخلاص منها لينضم إلى معشوقة وخادنة أخرى. ؟! جاء الإسلام لينصف المرأة ويصلها بخالقها، ويرشدها إلى هدف الوجود وقيمة الحياة, وليصف لها حياة السعادة في الدنيا والآخرة "مَنْ عَمِلَ صَالِحاً مِنْ ذَكَرٍ أَوْ أُنْثَى وَهُوَ مُؤْمِنٌ فَلَنُحْيِيَنَّهُ حَيَاةً طَيِّبَةً وَلَنَجْزِيَنَّهُمْ أَجْرَهُمْ بِأَحْسَنِ مَا كَانُوا يَعْمَلُونَ" (النحل:97)، ونزل القرآن ليعلن ضمان حقوق المرأة "فَاسْتَجَابَ لَهُمْ رَبُّهُمْ أَنِّي لا أُضِيعُ عَمَلَ عَامِلٍ مِنْكُمْ مِنْ ذَكَرٍ أَوْ أُنْثَى بَعْضُكُمْ مِنْ بَعْضٍ" (آل عمران: من الآية195)، وأكد المصطفى _صلى الله عليه وسلم_على حقوق المرأة، بل حرّج فقال: "اللهم إني أحرج حق الضعيفين اليتيم والمرأة" رواه ابن ماجه 3678/والبيهقي5/363 وصحح إسناده النووي.

وقام المسلمون بأرقى تعامل عرفته البشرية مع المرأة، بل أشرقت حضارتهم على الأمم, وتعلمت منهم الشعوب الأخرى كرامة المرأة، ويعترف أحد الغربيين (كوغوستاف لوبون)بذلك حين يقول: "إن الأوروبيين أخذوا عن العرب مبادئ الفروسية وما اقتضته من احترام المرأة، فالإسلام إذن, لا النصرانية هو الذي رفع المرأة من الدرك الأسفل الذي كانت فيه، وذلك خلافاً للاعتقاد الشائع, وإذا نظرت إلى نصارى الدور الأول من القرون الوسطى رأيتهم لم يحملوا شيئاً من الحرمة للنساء. وعلمت أن رجال عصر الإقطاع كانوا غلاظا ًنحو النساء قبل أن يتعلم النصارى من العرب أمر معاملتهن بالحسنى" (قالوا عن الإسلام د. عماد الدين خليل/431).

وإذا تشدق المبهورون اليوم بحضارة الغرب وقيمه، وحطوا من قيم حضارتهم جاءت شهادة المنصفين من الغرب تكذب هذا الادعاء وتثبت أن إصلاح المرأة في الغرب إنما تم بعد احتكاك المسلمين في أسبانيا(الأندلس) بالغرب. وفي هذا يقول (مارسيل بوازار) "إن الشعراء المسلمين هم الذين علموا مسيحي أوروبا –عبر أسبانيا-احترام المرأة " (قالوا عن الإسلام/409) إننا في فترات المراهقة الثقافية ننسى أصولنا، وننبهر بما عند غيرنا، ولكن اعترافات القوم تعيد إلى بعضنا التوازن، نعم لقد ظُلم ديننا، من بعض أبناء جلدتنا، وزهد البعض في ثقافتنا وقيمنا، وشوه وضع المرأة عندنا من قبل أعدائنا.

وشاء الله أن يُقام الشهود المنصفون من القوم على أنفسهم ومن سار في ركبهم، فهذه امرأة غربية تكشف الحقيقة بممارسة سلوكية واقعية حين تقول زوجة السفير الإنجليزي في تركيا: يزعمون أن المرأة المسلمة في استعباد وحجر معيب، وهو ما أود تكذيبه، فإن مؤلفي الروايات في أوروبا لا يحاولون الحقيقة ولا يسعون للبحث عنها، ولولا أنني في تركيا اجتمعت إلى النساء المسلمات ما كان إلى ذلك من سبيل. فما رأيته يكذب كل التكذيب أخبارهم عنها. إلى أن تقول ولعل المرأة المسلمة هي الوحيدة التي لا تعنى بغير حياتها البيتية، ثم إنهن يعشن في مقصورات جميلات. هكذا وتظل المرأة المسلمة معززة مكرمة موقرةً لها الحقوق ما بقي الإسلام عزيزاً، ويظل المسلمون أوفياء للمرأة ما داموا مستمسكين بالإسلام. وكلما تغرَّب الإسلام، أو انحرف المسلمون. عاد الظلم للمرأة بصورةٍ أو بأخرى. لا فرق بين هضم حقوقها. أو تلمس حقوقاً ليست لها لتشغلها عن حقوقها ووظائفها النسوية الأساسية. وهذه صور من ظلم المرأة للوعي بها واجتنابها, فهي تُظلم حين تُستخدم سلعةً رخيصة للدعاية والإعلان, وتُظلم المرأة حين تُزجُّ في عمل لا يتلاءم مع أنوثتها. أو يُزجُّ بها في مجتمع الرجال، تُظلم المرأة حين تُضرب بغير حق, أو تعضل لأدنى سبب, أو يتحرش بها جنسياً, أو تغتصب, أو تستغل في التجارة الجسدية, أو بحرمانها من الحياة الزوجية السعيدة, تُظلم المرأة حين يسلب حياؤها ويُعتدى على قيمها ويستهان بروحها وأشراقها. وتخدع بزينة عابرة, وأشكال وأصباغ زائلة، وتُظلم المرأة حين يُقَصِّر الولي أو المجتمع في تربيتها, وتُظلم المرأة حين تعرض للأمراض المختلفة كالزهري والسيلان والإيدز. ونحوها.

تُظلم المرأة حين يتأخر زواجها فتعنس, أو تمنع من الحمل والولد فتفلس, أو تزوج بغير إذنها وبمن لا ترغب, تُظلم المرأة حين يُسخط منها حين تولد, أو تُلعن وتسب حين تكبر، تُظلم المرأة حين يغالى في مهرها فيتجاوزها الُخطَّاب إلى غيرها أو تلزم بزوج لا ترغبه, وقد تجبر على زوج فاسد الدين أو سيئ الخلق, تُظلم المطلقة في ولدها, وقد تُظلم المرأة من أقرب الناس لها, تُظلم المرأة بضرتها, وتُظلم المرأة بإفشاء سرها لاسيما في أمر الفراش و"إن من شر الناس عند الله منزلة يوم القيامة الرجل يفضي إلى امرأته وتفضي إليه ثم ينشر سرها"(رواه مسلم/1437).

تُظلم المرأة حين يعتدى على مالها بغير حق أو يعتدى على حجابها وحيائها باسم التحضر. وثمة صور أخرى لظلم المرأة حين تقصر في طاعة الله, وترتكب المحرمات. وتضيع الأوقات وتسفل في همتها. وتكون الأزياء والموضة غاية مرادها. تُظلم المرأة حين تختزل حقوقها في قيادة. أو يٌزجُّ بها في خلطةٍ بائسة، أو تجد نفسها في كومة من الفضائيات الساقطة. أو تجر لمواقع عنكبوتية مشبوهة. تُظلم المرأة حين تهمش رسالتها الخالدة وتُصرف عبوديتها عن الخالق الحق إلى عبادة الأهواء والشهوات, وكم هو وأدٌ للمرأة حين يوحى لها أن نماذج القدوة ساقطاتُ الفكر, عاشقات الشهوة والشهرة.

وإن من أعظم ظلم المرأة أن يُلبس عليها الحق بالباطل ويستبدل الحسن بالقبيح, ويصور لها الحياة والعفة بالرجعية والتطرف على حين يصور لها السفور والاختلاط بالمدنية والانفتاح والتحضر؟ وكم تُظلم المرأة حين يقال لها أن من العيب أن يكفلها أبوها، أو ينفق عليها زوجها, ويلقى في روعها أن (القوامة) القرآنية ضعف وتبعية, وإن عليها أن تكد وتكدح لتتخلص من نفقة الآخرين وقوامتهم.

نعم لقد أصبح العامل الاقتصادي كلّ شيء في ذهن أدعياء تحرير المرأة ولذا تراهم يطالبون لها بأي عمل ويقحمونها في كل ميدان فتظل المسكينة تلهث متناسية أعباءها الأخرى وواجباتها الأسرية المقدسة فلا هي أمٌّ حانية ولا مربيةٌ ناجحة.
حتى إذا ذبلت الزهرة والتفتت الكادحة في - العمل بلا حدود - إلى المحصلة النهائية وجدت نفسها في العراء فلا هي أفلحت في التربية وبناء الأسرة ولا هي خلَّفت جاهاً يذكر وحشمة تشكر, وعادت تندب حظها كما ندبت نساء الغرب والشرق قبلها، وإذا أمكن قبول ظروف الغارقات في الوحل فلا يمكن بحال قبول ظروف امرأة مسلمة قال لها خالقها: "وَقَرْنَ فِي بُيُوتِكُنَّ وَلا تَبَرَّجْنَ تَبَرُّجَ الْجَاهِلِيَّةِ الْأُولَى وَأَقِمْنَ الصَّلاةَ وَآتِينَ الزَّكَاةَ وَأَطِعْنَ اللَّهَ وَرَسُولَهُ إِنَّمَا يُرِيدُ اللَّهُ لِيُذْهِبَ عَنْكُمُ الرِّجْسَ أَهْلَ الْبَيْتِ وَيُطَهِّرَكُمْ تَطْهِيراً" (الأحزاب:33).

ومن الظلم الواقع على المرأة إلى الظلم الملبس المرأة, فثمة دعوى وشبهات يخيل لبعض النساء أنهن مظلومات فيها وليس الأمر كذلك. لكنه تشويه وتزوير وتضليل وخداع ومن ذلك:
1- الدعوى بأن بقاء المرأة في بيتها ظلم لها، وهذه مغالطة تكشفها نصوص الوحيين فمن القرآن قوله تعالى: "وَقَرْنَ فِي بُيُوتِكُنَّ"، ومن السنة قال _عليه الصلاة السلام_: "قد أذن الله لكن أن تخرجن لحوائجكن "(رواه البخاري/5237) فدل قوله "قد أذن لكن" على أن الأصل البقاء في البيت، والخروج إنما يكون لحاجة, ويشهد بجدواها الغربيون ويقول أحدهم (جاك ريلر): "مكان المرأة الصحيح هو البيت, ومهمتها الأساسية هي أن تنجب أطفالاً"(قالوا عن الإسلام/ 415).

2- الادعاء بقصر مسمى عمل المرأة خارج منزلها, وعدم اعتبار عملها في منزلها عملاً يستحق الإشادة والتقدير، وليس الأمر كذلك بل اعتبر الشارع الحكيم عملها في بيتها شرفاً وكرامة, وكم نغفل عن مدونات السنة ومصطلحاتها, وفي صحيح البخاري عن عَلِيٌّ رضي الله عنه أَنَّ فَاطِمَةَ عَلَيْهَا السَّلام اشْتَكَتْ مَا تَلْقَى مِنْ الرَّحَى مِمَّا تَطْحَنُ فَبَلَغَهَا أَنَّ رَسُولَ اللَّهِ _صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ_ أُتِيَ بِسَبْيٍ فَأَتَتْهُ تَسْأَلُهُ خَادِمًا فَلَمْ تُوَافِقْهُ [ وفي رواية : أَنَّ فَاطِمَةَ _عَلَيْهِمَا السَّلام_ أَتَتْ النَّبِيَّ _صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ_ تَشْكُو إِلَيْهِ مَا تَلْقَى فِي يَدِهَا مِنْ الرَّحَى وَبَلَغَهَا أَنَّهُ جَاءهُ رَقِيقٌ فَلَمْ تُصَادِفْهُ ] فَذَكَرَتْ [ ذلك ] لِعَائِشَةَ فـ [َلما ] جَاءَ النَّبِيُّ _صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ_ ذَكَرَتْ ذَلِكَ عَائِشَةُ لَهُ فَأَتَانَا وَقَدْ دَخَلْنَا مَضَاجِعَنَا فَذَهَبْنَا لِنَقُومَ فَقَالَ: عَلَى مَكَانِكُمَا ( أي استمرا على ما أنتما عليه ) [ فجلس بيننا ] حَتَّى وَجَدْتُ بَرْدَ قَدَمَيْهِ عَلَى صَدْرِي فَقَالَ: أَلا أَدُلُّكُمَا عَلَى خَيْرٍ مِمَّا سَأَلْتُمَاهُ [ على خير مما هو لكما من خادم ] إِذَا أَخَذْتُمَا مَضَاجِعَكُمَا فَكَبِّرَا اللَّهَ أَرْبَعًا وَثَلاثِينَ وَاحْمَدَا ثَلاثًا وَثَلاثِينَ وَسَبِّحَا ثَلاثًا وَثَلاثِينَ فَإِنَّ ذَلِكَ خَيْرٌ لَكُمَا مِمَّا سَأَلْتُمَاهُ [ فهذا خير لكما من خادم.

فهل تستطيع امرأة أن تقول إنها خير من فاطمة؟. أو يقول رجل إنه خير لهذا العمل النسوي البيتي.

3- ومن دعاوى الظلم على المرأة القول بأن التعدد ظلم لها, وكم شوهت وسائل الإعلام بمسلسلاتها الهابطة, وأعمدتها الجانحة, صورة التعدد المشروع, والتعدد فوق أنه شرع رباني ليس لمؤمن ولا مؤمنة أن يكون لهم الخيرة من أمرهم فيه, فهو مضبوط بالعدل "فَانْكِحُوا مَا طَابَ لَكُمْ مِنَ النِّسَاءِ مَثْنَى وَثُلاثَ وَرُبَاعَ فَإِنْ خِفْتُمْ أَلَّا تَعْدِلُوا فَوَاحِدَةً" (النساء: من الآية3). والتعدد عوض عن الطلاق في حال عقم المرأة أو مرضها, أو عدم قناعة الزوج بها. فلا خيار في هذه الحالات أو نحوها. إلا الطلاق أو التعدد؟ على أن أمر التعدد الإسلامي عاد مطلباً لجمعيات الغرب, وفي أمريكا أكثر من جمعية يجوب أعضاؤها نساء ورجال مختلف الولايات الأمريكية داعين في محاضراتهم للعودة لنظام التعدد. وعاد نساء الغرب يدعين للتعدد, وتقول: أستاذة في الجامعة الألمانية: إن حل مشكلة المرأة في ألمانيا هو في إباحة تعدد الزوجات (ظلم المرأة/محمد الهبدان/78) ويعترف أحد الغربيين الذي هداهم الله للإسلام بأن التعدد في البلاد الإسلامية أقل إثماً وأخف ضرراً من الخبائث التي ترتكبها الأمم المسيحية تحت ستار المدنية, فلْنخرج الخشبة التي في أعيينا أولاً, ثم نتقدم لإخراج القذى من أعين غيرنا. (قالوا عن الإسلام/427).

وفي الوقت الذي يؤيد فيه غربي آخر تعدد الزوجات عند المسلمين معتبراً إياه قانوناً طبيعيا وسيبقى ما بقي العالم, هو في المقابل ينتقد النظام الغربي ويبين الآثار المترتبة على الإلزام بزوجة واحدة. ويقول (إيتين دينيه): إن نظرية التوحيد في الزوجة التي تأخذ بها المسيحية ظاهراً, تنطوي تحتها سيئات متعددة ظهرت على الأخص في ثلاث نتائج واقعية شديدة الخطر جسيمة البلاء, تلك هي: الدعارة، والعوانس من النساء، والأبناء غير الشرعيين.

4- ويزعمون كذلك أن دية المرأة نصف دية الرجل حيفٌ عليها، وينسون ويتناسون حكمة العليم الخبير بحاجة الرجل للمال للنفقة الواجبة عليه. ومع ذلك فهذه الدية للمرأة في حال قتل الخطأ، مثل دية الرجل كما جاء في الآية الكريمة، وفيها أن الرجل والمرأة سواء، وقد قيل حكمة ذلك: كذلك لما كانت الدية مواساة لأهل المقتول وتعويضاً لهم، فالخسارة المادية في الأنثى أقل منها عند الرجل، إذ الرجل يعمل ويوفر دخلا لأسرته أكثر، فخسارته أعظم من المرأة فكانت الدية في حقه أعظم (المرأة بين الجاهلية والإسلام/ 161 عن ظلم المرأة للهبدان 81).

هذه نماذج لدعاوى ظلم المرأة في الإسلام لا يقول بها إلا جاهل أو مغرض أو في قلبه مرض، وإلا فشهادة الأبعدين والأقربين أن ليس ثمة نظام أنصف المرأة كما أنصفها الإسلام، وليس ثمة شعوب أحسنت معاملة المرأة وضمنت حقوقها كما أحسنها المسلمون.
